1. Scope

This Privacy Policy explains how Discovered You International (Private) Limited, Trinco Road, Batticaloa, Sri Lanka, handles personal information when you use our websites, Service Studio, Client Access, Client Workspace, checkout, project services, communications and support channels.

2. Information we collect

Depending on your interaction with us, we may collect identity and contact information, business information, project specifications, uploaded files, billing and transaction records, account and authentication information, communications, support history, device/browser information and service usage data.

3. How we use information

We may use information to respond to enquiries, prepare quotations and estimates, create and administer accounts, perform contracts, deliver digital services, process transactions, communicate project updates, provide customer support, maintain security, prevent fraud or abuse, keep business records and improve our services.

4. Service providers and international processing

Digital delivery may require reputable third-party providers such as hosting companies, payment gateways, communications services, analytics services, software platforms and cloud infrastructure. Some providers may process information in other countries. We use providers where reasonably necessary for service delivery and seek appropriate safeguards where required.

5. Retention

We retain information for as long as reasonably necessary for the purpose for which it was collected, to provide ongoing services and support, maintain transaction and project records, resolve disputes, protect our legitimate business interests and meet applicable legal or regulatory requirements.

6. Security

We use reasonable administrative and technical measures designed to protect account and project information. No internet-based system can be guaranteed to be completely secure, and clients are responsible for maintaining the confidentiality of their credentials and devices.

7. Your requests

You may contact us to request access to, correction of or deletion of personal information where applicable. Some information may need to be retained where necessary for legal, accounting, security, fraud-prevention, contractual or legitimate business-record purposes.

1. Provider

These Terms apply to digital and professional services supplied by Discovered You International (Private) Limited, Trinco Road, Batticaloa, Sri Lanka, to clients in Sri Lanka and internationally.

2. Services

Services may include websites, web applications, mobile applications, software, automation, design, consulting, digital marketing, maintenance, integrations, technical support, configuration and other agreed digital or technology services.

3. Client requirements

The client is responsible for providing complete, accurate and sufficiently clear requirements, content, credentials, approvals, access and other information needed for quotation and delivery. Estimates and timelines are prepared using the information available at the time.

4. Approval and commencement

When the client approves an estimate, proposal, order, scope or project instruction and provides the required payment, Discovered You may treat the project as authorised to commence. Approval establishes the project baseline unless both parties agree to a change.

5. Scope changes

Requests that add new functionality, materially change approved requirements, replace an approved direction, introduce new integrations or otherwise fall outside the approved scope may be treated as additional work. Additional fees and revised delivery times may apply.

6. Revisions

Unless a project proposal states otherwise, up to three reasonable revision rounds are included for work that remains within the approved scope. A revision does not include a complete redesign, new functionality or replacement of previously approved requirements. Additional revision work may be separately quoted.

7. Milestone approvals

Approval of a design, document, feature, milestone or other stage confirms acceptance of that stage. Later changes to an approved stage may be treated as additional work.

8. Timelines and client delays

Delivery dates are estimates unless expressly guaranteed in writing. Delays in receiving client content, access, decisions, feedback, approvals or payments may extend the schedule. Client-caused delay does not itself create a right to a refund.

9. Intellectual property

Subject to the agreed project terms and full payment of all applicable invoices, rights in final custom deliverables may be transferred or licensed to the client as agreed. Discovered You retains ownership of its pre-existing intellectual property, reusable components, frameworks, internal tools, know-how, methodologies and materials that were not created exclusively for the client. Third-party assets remain subject to their own licences.

10. Client-supplied materials

The client is responsible for ensuring that it has the necessary rights and permissions to provide logos, text, photographs, video, trademarks, databases, documents, personal data and other materials supplied to Discovered You. The client is responsible for issues arising from materials or instructions it supplies, subject to applicable law.

11. Third-party services

Projects may depend on hosting providers, domain registrars, APIs, app stores, payment gateways, plugins, cloud services, communications platforms, AI providers or other third parties. Their availability, pricing, policies, approval decisions and service levels are outside Discovered You's direct control.

12. Results and performance

Unless expressly stated in writing, Discovered You does not guarantee specific revenue, sales, search-engine rankings, advertising performance, business outcomes, app-store approval or uninterrupted availability of third-party platforms.

13. Payment and suspension

Payments must be made according to the approved estimate, invoice or payment schedule. Discovered You may pause work, withhold final deliverables, credentials, deployment, source files or transfer of agreed rights while payment remains overdue, where permitted by applicable law and the project agreement.

14. Liability

To the extent permitted by applicable law, Discovered You is not responsible for indirect or consequential loss, lost profits, third-party platform failures, client-supplied errors, unauthorised client-side changes or events beyond reasonable control. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.

15. Governing framework

These Terms are intended to operate under the laws applicable to Discovered You International (Private) Limited in Sri Lanka, while recognising that mandatory consumer or data-protection rights may apply to clients in other jurisdictions.

Refunds & Cancellations

Your approval starts the commitment.

Once an approved project enters production, design, development, configuration, implementation or another delivery stage, professional time and resources are committed to your project.

A cancellation submitted before work begins can be reviewed, less applicable work, consultation, third-party, processing or non-recoverable costs.

After commencementGenerally non-refundable

Payments relating to approved work that has commenced are generally non-refundable, except where Discovered You agrees otherwise or applicable law requires otherwise.

1. Digital-service nature

Discovered You primarily supplies customised digital, technical and professional services. Once work is undertaken, the professional time, planning and digital output already consumed cannot be returned in the same way as a physical product.

2. Deposits and commencement payments

Where an estimate or checkout specifies a 35% deposit or another commencement payment, that payment reserves resources and authorises project commencement. Once the approved project has commenced or resources have been committed, the applicable commencement payment is non-refundable except where Discovered You agrees otherwise or applicable law requires otherwise.

3. Cancellation before work starts

If the client requests cancellation before work begins, Discovered You may review the request. Any approved refund may be reduced by consultation or planning already completed, administrative work, payment-processing charges, third-party purchases, licences, registrations, booking costs or other amounts that cannot reasonably be recovered.

4. Cancellation after work starts

Once an approved project has entered planning, design, development, configuration, implementation, procurement, testing, deployment preparation or another active delivery stage, payments attributable to that commenced work are generally non-refundable. A client's decision not to continue does not automatically reverse work already performed or resources already committed.

5. Change of mind and scope changes

A change of mind, change in business direction or request to replace previously approved requirements does not create an automatic refund right. Discovered You may instead offer a revised scope, credit arrangement or new quotation at its discretion.

6. Client delays

Failure to provide required information, content, access, feedback, approvals or other dependencies may pause or extend the project and does not itself create a refund entitlement.

7. Refund requests

Refund requests should be submitted to support@discoveredyou.com with the client's name, project or order reference, original payment details and the reason for the request. Discovered You may review project status, completed work, committed resources and non-recoverable costs before making a decision.

8. Refund route and timing

Where a refund is approved, Discovered You will normally return the approved amount through the same payment method or gateway used for the original transaction where technically and legally possible. Banks, card networks, payment gateways and international payment providers may apply their own processing periods, currency-conversion methods and charges.

9. International payments

For international transactions, the client may receive a different converted amount because of exchange-rate movement, intermediary-bank fees or payment-provider charges outside Discovered You's control. Unless required otherwise by law, Discovered You is not responsible for third-party exchange-rate differences or external processing fees.

10. Mandatory rights

This policy does not remove any refund or consumer right that cannot lawfully be excluded under applicable law.

1. Payment schedules

Projects may require full payment, a commencement deposit, milestone payments or another payment structure shown in the approved estimate, checkout or agreement.

2. Deposits

Where a 35% deposit or other commencement amount is specified, it is used to confirm commitment and reserve resources. Its refund treatment is governed by the Refund & Cancellation Policy and applicable law.

3. Payment providers

Payments may be processed through third-party banks, card networks or payment gateways. Those providers may apply their own authentication, processing, settlement, refund and currency-conversion rules.

4. International clients

International clients may incur bank, card, intermediary or currency-conversion charges imposed by third parties. Unless expressly agreed otherwise, such external charges are the client's responsibility.

5. Outstanding balances

Where payment remains overdue, Discovered You may pause further work or withhold final delivery, deployment, credentials, source files or agreed rights until the outstanding amount is settled, subject to applicable law and the project agreement.
